By booking a session, using our website, or signing up for services with Shalista Photography, you agree to these Terms of Service. Read them carefully.

Photography Services

Booking and Deposits: A non-refundable deposit is required to reserve your session date. Remaining balance is due before or at your session as specified in your package agreement.

Cancellations and Rescheduling: Cancellations or rescheduling requests must be made at least 48 hours in advance. Late cancellations may result in forfeiture of your deposit.

Session Deliverables: Specific deliverables (number of edited images, products, etc.) are outlined in your session contract and vary by package.

Usage Rights: Unless you purchase usage rights, all images remain our property. You may not print, share, post, or reproduce images without purchasing these rights.

Payment Terms

Accepted Payment Methods: We accept credit cards, debit cards, and other payment methods processed through secure payment platforms.

Refunds: Deposits are non-refundable. If we must cancel your session, you will receive a full refund or option to reschedule.

Late Payments: Missed payments on payment plans will pause work on your project. Continued non-payment may result in collection efforts and additional fees.

SMS Text Messaging Program Terms

Program Description:

By opting into our SMS program, you agree to receive text messages from Shalista Photography for the following purposes:

Marketing Messages:

  • Promotional offers and special discounts

  • New service announcements

  • Seasonal promotions

  • Limited-time booking opportunities

  • Newsletter updates via text

Transactional Messages:

  • Appointment confirmations

  • Session reminders (24-48 hours prior)

  • Booking confirmations

  • Payment receipts and reminders

  • Order status updates

  • Delivery notifications

Service Messages:

  • Session preparation tips and checklists

  • What to bring reminders

  • Location and timing confirmations

  • Weather-related updates

  • Emergency rescheduling notifications

Opt-In Consent:

By providing your mobile phone number and opting in through any method (website form, text keyword, checkbox at booking, or verbal/written consent), you provide express written consent to receive:

  • Text messages sent via automatic telephone dialing system

  • Prerecorded or artificial voice messages

  • Marketing and promotional communications

  • Transactional and service-related messages

You acknowledge that consent is not a condition of purchasing our services.

Message Frequency: Message frequency varies. Promotional messages: approximately 2-4 per month. Transactional messages: as needed based on active bookings and orders.

Opt-Out Instructions:

You may opt out of SMS messages at any time using any of these methods:

  1. Text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from 480-952-8779

  2. Reply STOP to any text message you receive from us

  3. Contact us directly at info@shalista.com or 480-952-8779 to remove your number

After opting out, you will receive one final confirmation message. Promotional messages will cease immediately. You may continue to receive critical transactional messages related to active bookings (appointment confirmations, cancellations, time-sensitive session information).

To opt back in after opting out, text START or contact us directly.

Message and Data Rates:

Standard message and data rates from your mobile carrier apply to all SMS communications. We do not charge fees for text messages, but your carrier may include messages in your plan limits or charge per-message fees. Contact your mobile carrier for details about your specific plan rates.

Number of messages varies by user activity and preferences. Typical usage: 2-10 messages per month.

Our SMS service is supported by most major U.S. mobile carriers including:

  • AT&T

  • Verizon Wireless

  • T-Mobile

  • Sprint

  • Boost Mobile

  • U.S. Cellular

  • Cricket Wireless

  • Metro PCS

  • Virgin Mobile

  • And most other major carriers

Check with your carrier to confirm compatibility. We are not responsible for messages that fail to deliver due to carrier limitations.

Carrier Liability Disclaimer:

Shalista Photography and our SMS service providers are not liable for:

  • Delayed or undelivered messages due to carrier network issues

  • Messages filtered or blocked by carrier spam filters

  • Service disruptions or outages

  • Carrier service limitations or restrictions

  • Compatibility issues with your specific device or carrier

  • Changes to carrier policies affecting message delivery

  • Any charges imposed by your mobile carrier

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier network availability and technical limitations beyond our control.

Device and Network Requirements:

To receive SMS messages, you must have:

  • A mobile device capable of receiving text messages

  • An active mobile phone plan with SMS capability

  • Sufficient network coverage

  • Permission from account holder if device is not in your name

SMS Program Changes:

We reserve the right to modify or terminate the SMS program at any time with or without notice. This includes:

  • Changes to message frequency

  • Changes to message content or types

  • Program suspension or termination

  • Changes to opt-in or opt-out procedures

Material changes will be communicated via text message or email when possible.

Age Restriction:

You must be 18 years of age or older to opt into SMS communications. By opting in, you certify that you are at least 18 years old and are the authorized user of the mobile phone number provided. If you are under 18, you must have explicit permission from a parent or legal guardian who owns the mobile device and account.

Minors under 18 may participate in photography sessions but may not independently consent to SMS marketing communications.

Privacy and Data Use:

Your mobile phone number and SMS data are subject to our Privacy Policy. By opting into SMS, you acknowledge that:

  • We collect and store your mobile phone number

  • We track message delivery and engagement

  • We may use this data to improve our services

  • Your information is shared with our SMS service provider (GoHighLevel/GHL)

  • We do not sell your mobile number to third parties

Image Usage and Copyright

Copyright Ownership: We retain full copyright and all rights to photographs created during your session.

Your Usage Rights: You may only use images after purchasing usage rights. Without purchased rights, you may not print, share, post, or reproduce images.

Our Usage Rights: We may use your images for portfolio, website, social media, advertising, competitions, and promotional purposes unless you purchase privacy restrictions.

Model Release: By participating in a session, you grant us permission to use your likeness in photographs for the purposes outlined above, unless privacy restrictions are purchased.

Your Content: If you provide images, ideas, or content to us, you confirm that you own them or have permission to share them.

Website Use

Acceptable Use: You may not use our website to:

  • Transmit malware, viruses, or harmful code

  • Attempt unauthorized access to our systems

  • Scrape or harvest data

  • Spam or send unsolicited communications

  • Violate any laws or regulations

  • Infringe on intellectual property rights

Account Security: If you create an account, you are responsible for maintaining password confidentiality and all activity under your account.

Intellectual Property: All website content (text, images, designs, logos, code) is protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works without written permission.

Limitation of Liability

We will make every effort to provide excellent service and beautiful photographs. However:

We Are Not Liable For:

  • Equipment malfunctions or technical failures beyond our control

  • Circumstances caused by force majeure (natural disasters, emergencies, pandemics)

  • Results affected by challenging conditions we disclosed in advance

  • Personal dissatisfaction with your appearance in photos

  • Lost or corrupted data due to circumstances beyond our control

Maximum Liability: Our total liability for any claim is limited to the amount you paid for your session. We are not liable for indirect, incidental, consequential, or punitive damages.

Indemnification

You agree to indemnify and hold harmless Shalista Photography from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms of Service

  • Your violation of any third-party rights

  • Your misuse of images or services

  • Your provision of false or misleading information

Dispute Resolution

Initial Resolution: If you have a dispute, contact us first at info@shalista.com or 480-952-8779. We will work in good faith to resolve the issue.

Governing Law: These Terms are governed by the laws of the State of Arizona.

Venue: Any disputes will be resolved in the courts of Maricopa County, Arizona.

Arbitration: For unresolved disputes, both parties agree to binding arbitration in accordance with the American Arbitration Association rules, rather than court litigation.

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class action lawsuits.

General Provisions

Entire Agreement: These Terms, your session contract, and our Privacy Policy constitute the complete agreement between you and Shalista Photography.

Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.

No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.

Assignment: We may assign these Terms to another party (such as in a business sale). You may not assign your rights without our written consent.

Force Majeure: We are not liable for failure to perform obligations due to circumstances beyond our reasonable control.

Amendments: We may update these Terms at any time. Changes will be posted with an updated "Last Updated" date. Material changes will be communicated via email or SMS. Continued use of services after changes constitutes acceptance.

Headings: Section headings are for convenience only and do not affect interpretation.

Age Requirement for Services

You must be 18 years or older to independently contract for our services. Minors may participate in photography sessions with parental or guardian consent and participation.
