Welcome!
Thanks for choosing Shalista Photography! These terms explain how we work together. I've written this in plain English because nobody likes wading through legal jargon.
By booking a session, using my website, or signing up for my services, you're agreeing to these terms. If something doesn't make sense, just ask.
Photography Services
Booking and Deposits: When you book a session, I require a non-refundable deposit to hold your spot. The remaining balance is due before or at your session (depending on your package). No payment, no photos. It's that simple.
Session Details: Your session time is reserved just for you. If you need to reschedule, give me at least 48 hours notice. Last-minute cancellations? You might forfeit your deposit.
What I Provide: The specific deliverables are outlined in your session contract. This typically includes a set number of edited digital images, but the details depend on what package you choose.
What You Don't Get: Unless you specifically purchase usage rights, the images remain my property. You can't print them, post them, or use them commercially without purchasing those rights first.
Payment Terms
Accepted Payment Methods: I accept credit cards, debit cards, and other payment methods processed through secure payment platforms.
Refunds: Deposits are non-refundable. If I need to cancel your session (hey, life happens), you'll get a full refund or the option to reschedule.
Late Payments: If you're on a payment plan and miss a payment, I'll pause work on your project until we're square. Continued non-payment may result in collection efforts (and nobody wants that hassle).
SMS Text Messaging Terms
Opt-In Required: By providing your mobile number and opting in, you agree to receive text messages from Shalista Photography. This includes appointment reminders, promotional offers, session updates, and other service-related communications.

Message and Data Rates: Standard message and data rates from your mobile carrier apply. I don't charge you for texts, but your carrier might.
Supported Carriers: My SMS service works with most major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and many others. Check with your carrier if you're unsure.
No Liability for Carrier Issues: I'm not responsible for delayed or undelivered messages due to carrier issues, network problems, or your phone settings.
Privacy: Your mobile number and text message data are handled according to my Privacy Policy. I won't sell or share your number with third parties for their marketing purposes.
Consent Not Required for Purchase: You don't have to sign up for text messages to book a session or purchase my services. It's just a convenient way to stay connected.
Changes to SMS Program: I can modify or cancel the SMS program anytime. If I make major changes, I'll let you know via text or email.
Image Usage and Copyright
Let's be crystal clear about this:
I Own the Copyright: All photographs created during your session are my intellectual property. I hold all rights, title, and interest.
Your Usage Rights: You only get to use the images if you purchase usage rights as part of your package or as an add-on. Without purchased rights, you can't print, share, post, or reproduce the images. Period.
My Usage Rights: I can use your images for my portfolio, website, social media, advertising, competitions, and other promotional purposes unless you specifically purchase a privacy upgrade that restricts this.
Model Release: By participating in a session, you grant me permission to use your likeness in photographs for the purposes outlined above, unless you've purchased privacy restrictions.
Your Content: If you provide images, ideas, or other content to me (like inspiration photos), you confirm that you own them or have permission to share them.
Website Use
Acceptable Use: Don't do anything sketchy on my website. No hacking, no spamming, no uploading viruses, and no stealing my content.
Your Account: If you create an account, keep your password secure. You're responsible for any activity under your account.
Intellectual Property: Everything on my website (text, images, design, logo) is protected by copyright. Don't copy, reproduce, or use it without my written permission.
Limitation of Liability
Here's the legal stuff I have to say:
I'll do my absolute best to create amazing photos for you. But sometimes things happen that are beyond anyone's control (equipment failure, natural disasters, zombie apocalypses, you name it).
What I'm Not Responsible For:
Technical failures or equipment malfunctions
Circumstances beyond my reasonable control
Photos that don't turn out due to challenging lighting or conditions I warned you about
Your dissatisfaction with how you look in photos (I'll make you look amazing, but I can't change bone structure)
Maximum Liability: If something goes wrong, my total liability is limited to the amount you paid me for your session. I won't be liable for any indirect, incidental, or consequential damages.
Indemnification
You agree to defend and hold me harmless from any claims, damages, or expenses (including legal fees) arising from:
Your violation of these terms
Your violation of anyone else's rights
Your misuse of the images or services
Dispute Resolution
Let's Talk First: If you have a problem, reach out to me directly. I'll do everything I can to make it right.
Governing Law: These terms are governed by the laws of Arizona. Any disputes will be resolved in the courts of Maricopa County, Arizona.
Arbitration: For disputes that can't be resolved between us, we agree to binding arbitration rather than court litigation (it's faster and cheaper for everyone).
General Terms
Entire Agreement: These terms, along with your session contract and my Privacy Policy, make up our complete agreement.
Severability: If any part of these terms is found to be unenforceable, the rest still applies.
No Waiver: If I don't enforce a term one time, that doesn't mean I've given up the right to enforce it later.
Assignment: I can transfer these terms to someone else (like if I sell my business). You can't transfer your rights without my permission.
Changes to Terms: I can update these terms anytime. If I make significant changes, I'll notify you via email or text. Continued use of my services means you accept the new terms.
